Requirements main to request regularisation

To be able to request this authorisation, some basic requirements must be met.

To have arrived in Spain before 1 January 2026

The process is intended for people who were already living in Spain before that date.

02.

Remain in Spain for at least 5 months before submitting the application

At the time of submitting the application, you must demonstrate that You have remained in Spain for at least five consecutive months, with no departures from the country during that period.

03.

To have a passport

You must provide a A full copy of your valid passport or travel document.

04.

Not having a criminal record in the country/countries where you have resided for the last 5 years.

You must not have a criminal record or pose a threat to public order or safety.

05.

Not to be prohibited from entering Spain

You cannot be in the process of expulsion or have an entry ban to the territory.

If you have not applied for international protection before 1 January 2026

To be able to benefit of the regularisation Extraordinary, you will need to provide proof of one of the following situations

Scenario 1

I applied for international protection before 1 January 2026. Those who have lost their status as international protection applicants, even if a negative decision has been made regarding their application, or if the application or any appeal lodged against that decision has been withdrawn, will be able to access this authorisation.

Document proving the submission of the international protection application before 1 January 2026 (white sheet or red card)

Criminal Record

Should you be unable to obtain the certificate of good conduct because the consulate or institution does not provide it to you in time, you can submit proof of your application along with a sworn declaration and authorisation for the Spanish authorities to obtain it.

Scenario 2

I am not an applicant for international protection (nor have I been), but I can prove employment ties, family ties or a vulnerable situation. It is advisable, although not mandatory, to prove the solvency of the company by presenting supporting documentation. How can I prove it?

a) Employment relationships:

To have worked in Spain (employed or self-employed): you can provide your employment history report, or previous employment contracts and payslips
To believe you have a job offer in Spain (contract or contracts totalling more than 90 days in a year). The company must be solvent and have no outstanding debts with the tax authorities or social security.
Present a sworn statement demonstrating your intention to work for yourself in Spain (We explain how to do this when you hire the service).

b) Family Ties

Remain in Spain with your family unit, comprising minor children, and/or adult children with disabilities who require support, and/or first-degree ascendants – father, mother – with whom you live. You will need to provide the following documentation:
Documents proving the Family relationship Birth, marriage and/or civil partnership certificates.
Documentation proving joint living (Certificate of joint registration).

Documents not issued by Spanish authorities must be apostilled and, where applicable, translated.

Regularise your minor children or dependent adult children with you in any of these scenarios! For this, you will need the following documentation:

Full copy of your child's passport or travel document.
To credit the family ties Apostilled and, if applicable, translated birth certificate.
Test of Minor's Residence Documents proving your stay in Spain during the 5 months prior: joint registration of both of you at your address, or failing that: school reports, paediatric reports, public transport top-up history, etc...).

How long do I need to reside in order to apply for the Spanish nationality?

One of the most important requirements for applying for Spanish nationality is to have legally resided in Spain lawful, continuous and immediately prior to the submission of the application. However, the required period of residence is not the same for everyone, as the legislation provides for different situations that can reduce the necessary timeframe.

Below are the main assumptions:

General time limit: 10 years of legal residence

As a general rule, any foreign national may apply for Spanish nationality once they have resided lawfully and continuously for ten years in Spain. This is the period that applies in the majority of cases and constitutes the standard route to acquiring nationality.

Refugee persons: 5 years of residence

People who have been officially recognised as refugees in Spain can apply for Spanish nationality after five years of lawful and continuous residence. This reduction in the time limit is in response to the special protection that Spanish legislation grants to those who have obtained this status.

Nationals of certain countries: 2 years' residency

Spanish legislation establishes a reduced period of two years of legal and continuous residency for nationals of countries with which Spain shares a special historical, cultural or linguistic connection.

This benefit applies to citizens of:

Bolivia
Chile
Colombia
Costa Rica
Cuba
Dominican Republic
Ecuador
El Salvador
Guatemala
Honduras
Mexico
Nicaragua
Panama
Paraguay
Peru
Uruguay
Venezuela

Furthermore, nationals of the following countries are also eligible for this reduced period:

Just like people of Sephardic origin, in the cases provided for by regulations.

Special assumptions: 1 year of residency

There are certain personal circumstances in which the residency period is reduced to just one year. Some of the most common cases are:

Having been born in Spanish territory.
Being married to a person of Spanish nationality for at least one year and not being legally or de facto separated.
Being a widower or widow of a Spanish citizen, provided there was no separation at the time of death.
Having been legally subject to the tutelage, guardianship or foster care of a Spanish citizen or institution for the time established by law.
